Pittsburg Elite LLC Waiver
The novel corona virus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person to person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Pittsburg Elite LLC has put in place preventative measures to reduce the spread of COVID-19; however, Pittsburg Elite LLC cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending Pittsburg Elite LLC could increase your risk and your child(ren)’s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19, and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending Pittsburg Elite LLC and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at Pittsburg Elite LLC may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Pittsburg Elite LLC employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including but not limited to injury, illness, permanent disability, and death), damage, loss, claim, liability, or expense of any kind, that I or my child(ren) may experience or incur in connection with my own or my child(ren)’s attendance at Pittsburg Elite LLC or participation in Pittsburg Elite LLC programming (“claims”). On my behalf, and on behalf of my child(ren), I hereby release, covenant not to sue, discharge, and hold harmless Pittsburg Elite LLC, its employees, agents, and representatives of and from the claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any claims based on the actions, omissions, or negligence of Pittsburg Elite LLC, it’s employees, agents, and representatives, whether a COVID-19 infections occurs before, during, or after participation in any Pittsburg Elite LLC program.
I hereby grant the permission necessary to allow the Minor to participate in Pittsburg Elite LLC activities. I acknowledge and agree, in my own behalf and on behalf of the Minor, that such participation subjects Minor to the possibility of physical illness or injury (minimal, serious, catastrophic and/or death) and that I, in my own behalf and on behalf of the Minor, acknowledge that the Minor is assuming the risk of such illness or injury by participating in the event. In the event of such illness or injury, I authorize Pittsburg Elite LLC Inc to obtain necessary medical treatment for the Minor and hereby, in my own behalf and behalf of the Minor, release affiliates (herein collectively “Releasees”) in the exercise of the authority. I further acknowledge and understand that I am responsible for any and all medical and related bills that may be incurred on behalf of the Minor for any illness or injury that the Minor may sustain during the event and while traveling to and from the site for the event whether or not the event actually occurs.
I, in my own behalf and on behalf of the Minor, further agree to release and hold harmless from any and all liability for negligence or any other claim, judgment, loss liability, cost and expenses (including, without limitations, attorney’s fees and costs) arising out of or connected with the event, including any claim arising out of or connected with any illness or injury that the Minor may incur or sustain during the event, all activities associated with the event and while traveling to and from the site of the heirs, successors, assignees, executors and administrators against loss form any further claims, demands or actions that may subsequently be brought by Minor and by any person or persons on account of damages of any character loss, damages or costs Releasees may have to pay as a result of any such action, claim or demand
I release the use of my photo, quoted information, and/or video for use in Pittsburg Elite LLC and/or website for promotional purposes.
I authorize the use of photos, quotes and/or video, my name, likeness, and performance for general educational, non-commercial purposes by Pittsburg Elite LLC for as long or as often as is deemed necessary. My name, likeness, and biography may be used for publicizing and promoting Pittsburg Elite LLC programs.
I hereby release Pittsburg Elite LLC from any claim by me for damage to my person, property or reputation, or for invasion of privacy.
I affirm that to the best of my knowledge all material furnished and used by me in this activity is my own original material which I have full authority to use for such purposes. I further affirm that Pittsburg Elite LLC is the owner of all rights in and to said activity and that no monetary consideration is due me.
